OVERVIEW

This Privacy Policy applies to personal information collected by Jillian Wallace and Associates Pty Ltd (ABN 88 606 505 097). We are bound by the Australian Privacy Principles and the Privacy Act 1988 (Cth), which govern the way private sector organisations collect, use, keep secure and disclose personal information.

This privacy policy is to provide information on how your personal information (which includes your health information) is collected and used within Jillian Wallace and Associates, and the circumstances in which we may share it with third parties.

CONSENT

When we initially meet with you following referral from an insurer or employer, we will provide a written consent form for you to sign. By signing this consent form, you provide permission for Jillian Wallace and Associates to access and use your personal information so we can provide you with the best possible service relevant to return to work rehabilitation services. Only staff who need to see your personal information will have access to it. If we need to use your information for anything else, we will seek additional consent from you to do this.

PERSONAL INFORMATION

Jillian Wallace and Associates will need to collect your personal information to provide return to work rehabilitation services to you. Our main purpose for collecting, using, holding and sharing your personal information is to manage your return to work rehabilitation.

The information we will collect about you includes your:

  • names, date of birth, addresses, contact details
  • medical information including medical history relating to your injury claim

COLLECTION

Jillian Wallace and Associates may collect your personal information in several different ways primarily when you meet with our team to discuss your return to work rehabilitation.

During the course of providing return to work services, we may collect further personal information.

We may also collect your personal information when you send us an email or SMS and telephone us.

 In some circumstances personal information may also be collected from other sources. Often this is because it is not practical or reasonable to collect it from you directly. This may include information from:

  • Your guardian or responsible person
  • Other involved healthcare providers, such as specialists, allied health professionals, hospitals, community health services and pathology and diagnostic imaging services

SHARE

We sometimes share your personal information:

  • with other healthcare providers
  • when it is required or authorised by law (eg court subpoenas)

Only people who need to access your information will be able to do so. Other than in the course of providing return to work services or as otherwise described in this policy, Jillian Wallace and Associates will not share personal information with any third party without your consent.

We will not share your personal information with anyone outside Australia (unless under exceptional circumstances that are permitted by law) without your consent.

Jillian Wallace and Associates will not use your personal information for marketing any of our goods or services directly to you without your express consent. If you do not consent, you may opt out of direct marketing at any time by notifying Jillian Wallace and Associates in writing. 

SECURITY AND STORAGE

We have taken steps to help secure and protect your personal information from unauthorised access, use, disclosure, alteration, or destruction. You will appreciate, however, that we cannot guarantee the security of all transmissions or personal information, especially where human error is involved or malicious activity by a third party.

Notwithstanding the above, we will take reasonable steps to:

  • make sure that the personal information we collect, use or disclose is accurate, complete and up to date;
  • protect your personal information from misuse, loss, unauthorised access, modification or disclosure both physically and through computer security methods; and
  • destroy or permanently de-identify personal information if it is no longer needed for its purpose of collection.

ACCESS

You have the right to request access to, and correction of, your personal information.

Jillian Wallace and Associates acknowledges you may request access to your medical records. We require you to put this request in writing and Jillian Wallace and Associates will respond within 30 days. Please be aware there is an administration fee applicable for same which has to be paid prior to the release of any information.

Jillian Wallace and Associates will take reasonable steps to correct your personal information where the information is not accurate or up to date. From time to time, we will ask you to verify that your personal information held by Jillian Wallace and Associates is correct and current. You may also request that we correct or update your information, and you should make such requests in writing.

COMPLAINTS

We take complaints and concerns regarding privacy seriously. Any privacy concerns you may have are preferred to be in writing. We will then attempt to resolve it in accordance with our resolution procedure.

If you have any concerns or complaints about the manner in which your personal information has been collected, used or disclosed by us, we have put in place an effective mechanism and procedure for you to contact us so that we can attempt to resolve the issue or complaint.

This privacy policy will be reviewed regularly to ensure it is in accordance with any changes that may occur.
